1. Applicability

This privacy notice governs Zaio's use of nonpublic personal information concerning a consumer that Zaio receives from time to time while providing appraisal and other financial services for the consumer or nonaffiliated financial institution in connection with a financial product or service requested or authorized by the consumer. With certain exceptions, the federal Gramm-Leach-Bliley Act prohibits Zaio from disclosing nonpublic personal information, directly or through any affiliate, to nonaffiliated third parties, unless the consumer has been provided with appropriate notices and has not elected to opt out of the disclosure after reasonable opportunity to do so. However, Zaio sufficiently limits its use of nonpublic personal information so that notices are not required unless the consumer establishes a direct customer relationship with Zaio, in which case only notice is required without any opportunity to opt out of the disclosure.

2. Type of Information

The type of information that Zaio generally collects consists of real estate appraisal information and other information received by Zaio on applications, forms and other communications from the consumer or financial institution providing a financial product or service requested or authorized by the consumer, whether in writing, online, in person, by telephone or any other means.

3. Customer Relationship

In those instances where a consumer has established a direct customer relationship with Zaio to provide financial services, the customer is entitled to receive Zaio's privacy notice not later than the time that the customer relationship is established, and not less than once in any 12-month period thereafter as long as the customer relationship continues. For this purpose, the customer relationship shall be deemed to be terminated upon closing of the real estate transaction for which Zaio provided services.

4. Consumer Relationship with Other Financial Institution

In those instances where a consumer's customer relationship is with a financial institution other than Zaio, and Zaio is providing appraisal and other financial services to such financial institution in connection with a financial product or service requested or authorized by the consumer, such consumer is not entitled to receive Zaio's privacy notice.

5. Use of Information

The nonpublic personal information of consumers collected by Zaio is used by Zaio to provide appraisal or other financial services in connection with servicing or processing a financial product or service requested or authorized by the consumer and as permitted by law. Such limited use is exempt from federal law's prohibition against disclosure to nonaffiliated third parties without appropriate notice to the consumer and giving the consumer an opportunity to opt out of the disclosure.

6. Confidentiality and Security

Zaio maintains physical, electronic and procedural safeguards to protect nonpublic personal information of consumers. Employees are authorized to access such information only as needed to provide products and services authorized or requested by consumers, and are bound by confidentiality policies subjecting them to disciplinary action if they fail to follow these policies.

This privacy notice applies to consumer and customer relationships established in the United States. A new privacy notice will be posted whenever there are significant changes.
